Salman Khan Wins Defamation Case Against Abhinav Kashyap

A Mumbai court has temporarily barred filmmaker Abhinav Kashyap from making or publishing any derogatory comments about Salman Khan and his family. The court emphasised that while freedom of speech is a fundamental right, it does not permit the use of abusive or threatening language against individuals.

According to PTI, the court issued an ex-parte injunction on Friday, preventing Kashyap from posting or sharing any defamatory content against Salman Khan and his relatives while a defamation lawsuit is ongoing. The judge, PG Bhosale, stated that free speech does not extend to insulting or threatening others. The lawsuit, filed by Salman Khan, seeks a permanent injunction and Rs 9 crore in damages.

What Does The Lawsuit Allege?

The lawsuit alleges that Abhinav Kashyap has made false, derogatory, and defamatory remarks targeting Salman Khan, his family, and his professional reputation. Several social media platforms are also named as respondents in the case. The complaint claims that Kashyap’s videos, broadcast on channels like “Bollywood Thikana” and various podcasts, contain statements that attack Salman’s personal character, professional integrity, and family members—including his father Salim Khan and brothers Arbaaz and Sohail Khan.

Specific accusations include Kashyap allegedly calling the Khan family “convicted criminals” and members of a “jihadi ecosystem,” as well as making offensive comments about Salman’s appearance, age, and personal life.

Court Notes Kashyap’s Remarks As Defamatory

Salman Khan also sought urgent interim relief. Upon reviewing Kashyap’s statements during a podcast interview, the court found them to be “prima facie defamatory, derogatory, abusive, and insulting.” The court noted that such remarks damage Salman’s reputation in the eyes of the public. The court underscored that nobody’s privacy or image should be harmed by defamatory statements, especially against one’s family. It clarified that the right to free speech does not justify using abusive or threatening language against others.

Court Verdict

Consequently, the court temporarily restrained Kashyap and others from making, uploading, sharing, or circulating any further defamatory or derogatory content related to Salman Khan or his family on any social media platform. They are also barred from giving interviews, communicating, or publishing any such content until they respond to the lawsuit.
