The Bombay High Court has issued an interim order restraining filmmaker Santosh Kumar RS from making any further remarks about the script of the Hindi film Dhurandhar 2, which were deemed defamatory by the film’s writer-director Aditya Dhar. Justice Arif S Doctor passed the order in a defamation suit filed by Dhar against Kumar. The Court observed that although Kumar had been served notice, no one appeared on his behalf.

The Court granted Dhar limited interim relief, noting that he had established a prima facie case for such relief, as reported by Bar and Bench. “Until the next date, the defendant (Kumar) shall be restrained from repeating words set out in the suit, and all other allegations of a similar nature. Issue notice,” the Court directed.
It clarified that this order is specifically against Kumar and will remain in effect until April 16. This will be until the matter is scheduled for further hearing.
Kumar’s Accusations On Dhar’s Dhurandhar 2
Dhar’s defamation case stems from comments made by Kumar during a press conference held days after the release of Dhurandhar 2. Kumar is accused of alleging that Dhar and the film’s makers had copied his registered script titled D Saheb.
Following the press conference, Dhar issued a legal notice to Kumar. He denied any plagiarism and cautioned Kumar against making such comments again. Kumar did not respond to the notice, leading Dhar to approach the Bombay High Court for relief.
Dhar’s plea seeks an injunction and damages for Kumar’s statements, which he claims are baseless and defamatory.
Dhar’s Advocate’s Argued
Senior Advocate Birendra Saraf represented Dhar before the Court today, arguing that Kumar’s remarks were highly prejudicial and defamatory. “All I seek is, if he has a grievance about infringement, he himself said I am going to initiate legal proceedings. He can initiate legal proceedings, and I will respond to the same appropriately. But in the meanwhile, he can’t use such language,” Saraf stated.
The Court granted Dhar interim relief after noting that the allegedly defamatory comments had been widely circulated. “In my view, the plaintiff has made out a case for the grant of limited ad-interim relief,” the Court concluded.
