Over the last few months, several celebrities, including Aishwarya Rai, Abhishek Bachchan, Amitabh Bachchan, Karan Johar, Rishab Shetty, Jaya Bachchan, Hrithik Roshan, and Akkineni Nagarjuna, moved court to seek protection of their personality rights. Now, joining them is actress Shilpa Shetty. As per a recent report, Shetty has filed a case in the Bombay High Court seeking personality rights protection.
The resurfacing of several morphed pictures and videos of the actress is cited as the reason prompting Shilpa to take such steps. Scroll down for more details.
Shilpa Shetty Approaches Bombay HC To Protect Her Personality Rights
As reported by Hindustan Times, Shilpa Shetty’s suit has been filed by advocate Sana Raees Khan. Sana informed the publication, “Ms Shilpa Shetty has built her reputation over decades of work, and no entity can appropriate her name or likeness without consent. The unauthorised commercial exploitation of her identity is an outright assault on her dignity and hard-earned reputation. No individual or platform has the right to exploit her reputation for unlawful commercial gain, and we will ensure strict enforcement of her personality rights. We have moved the Bombay High Court to put a stop to such misuse and to safeguard her identity from being treated as a commodity.”
India Today quoted Khan saying, “The misuse of Ms Shilpa Shetty’s name, image and identity has reached a point where legal intervention became imperative. Her persona is the product of decades of credibility, discipline and public trust. No platform has the right to weaponise her identity for clandestine commercial gain. Our suit before the Bombay High Court signals zero tolerance for the rampant misuse of celebrity rights.”
What Are Personality Rights?
Personality rights refer to an individual’s legal entitlement to control the commercial and public use of their identity. These rights safeguard attributes that are uniquely linked to a person, such as their name, image, likeness, voice, signature, or even trademark catchphrases, from being exploited without consent.
These rights are broken into two branches – the Right of Publicity and the Right to Privacy. Right of Publicity protects against unauthorised commercial exploitation – such as using a celebrity’s face in advertisements. The Right to Privacyguards against intrusion into personal dignity. This also covers misuse through deepfakes, morphed images, fabricated endorsements, or intimate doctored content.
