In the latest development in Sunjay Kapur’s inheritance dispute, the Delhi High Court has issued an order to his mother, Rani Kapur, following a petition filed by Priya Sachdev seeking the dismissal of Rani’s suit. The case pertains to ongoing allegations related to the late industrialist Sunjay Kapur’s estate. On Wednesday, the court issued a notice to Rani Kapur after Priya Sachdev filed an application requesting the court to dismiss her mother-in-law’s civil suit. For context, Rani had previously approached the court claiming that Priya had orchestrated a ‘fraudulent family trust.’
Priya Sachdev Files Application To Dismiss MIL Rani Kapur’s Accusations
As reported by ANI, the matter was heard before Justice Mini Pushkarna, who granted Rani Kapur four weeks to respond to Priya’s applications. The court also permitted Priya to file a rejoinder within two weeks. Additionally, a separate application filed by Priya Sachdev, alleging that Rani Kapur committed perjury during proceedings, resulted in the court issuing a notice to Rani. Senior Advocate Akhil Sibal, representing Priya, argued that many of the allegations made in Rani’s suit were “completely false.”
Rani Kapur’s Allegations
Rani Kapur challenged the RK Family Trust Deed dated October 26, 2017, seeking its cancellation and the return of assets she claims were transferred fraudulently. She alleged that the trust was created without her informed consent and that she was excluded from assets that originally belonged to her.
Rani further stated that these transactions occurred when she was unwell. She stated that she suffered a stroke and dependent on her son for managing her affairs. She claimed that she was made to sign documents without fully understanding their legal implications.
Senior Advocate Vaibhav Gaggar, appearing for Rani Kapur, earlier sought to preserve the estate, expressing concern that assets might be siphoned off. He accused Priya Kapur of acting hastily and fraudulently in handling the estate. His plea was supported by some defendants, including Rani’s daughter and the children of actress Karisma Kapoor.
Priya Kapur strongly denied these allegations. Senior Advocate Akhil Sibal argued that when Sunjay Kapur took control of the company, it was incurring losses. He stated that through Sunjay’s efforts, the business was revived and eventually prepared for an IPO in 2021. Sibal also questioned the legality of the suit, asserting that a trustee cannot legally challenge a trust and that videographic evidence regarding the execution and notarization of documents would be produced before the court.
Earlier, the court summoned Priya Kapur and 22 other defendants in connection with the civil suit. It involves a trust valued at several thousand crore rupees. The court emphasized the importance of transparency, noting that all relevant documents. It includes trust deeds, meeting minutes, and financial records—must be submitted, and that no material facts should be concealed.
What Was Rani Kapur’s Previous Allegations?
Rani Kapur further claimed she was the sole settlor, trustee, and beneficiary of earlier family trusts, and that the RK Family Trust was established without her knowledge or consent. She asserted that the signatures attributed to her on the trust documents were forged and that she was left without a share in the estate following her son’s death in June last year, with a significant portion of the assets transferred to Priya Kapur and the remainder to their children.
The court has scheduled the next hearing for March 23 to further examine the case.
