Vivek Oberoi has filed a petition in the Delhi High Court seeking protection for his personality and publicity rights, citing widespread misuse of his identity through fake social media accounts, unauthorised merchandise, and AI-generated content, including deepfake imagery. This move comes amid a rising trend of celebrities, such as Aishwarya Rai Bachchan, Abhishek Bachchan, and NTR Jr, seeking legal action to curb such infringements.
Vivek Oberoi Reaches Delhi HC For Protection Of Personality And Publicity Rights
The civil lawsuit was filed against Collector Bazar, ZoomMantra, Indiacontent, and other parties. It includes unidentified defendants referred to as John Doe. It aims to secure a permanent injunction to prevent further infringement of Oberoi’s rights. The case has been filed through advocates Sana Raees Khan and Pranay Chitale.
What Does The Petition Cover?
In his petition, Oberoi asserts that his name, image, voice, likeness, and other unique attributes are being unlawfully exploited for commercial gain without his consent. The complaint details how the defendants are impersonating him on social media platforms like Instagram by creating fake accounts using his name and images. Additionally, unauthorised merchandise such as posters, T-shirts, and postcards bearing his likeness is being sold across various e-commerce sites.
The suit also highlights the creation and distribution of AI-generated content that falsely depicts Oberoi in derogatory, insulting, and demeaning ways. It raises concerns over the use of deepfake technology to morph and superimpose his face onto objectionable imagery, further damaging his reputation.
Oberoi has requested the court to issue an omnibus “John Doe” injunction against unknown individuals involved in these violations. Citing irreparable harm to his goodwill, reputation, and business interests, he has urged for urgent court directions to remove unauthorised posters, videos, and social media posts, and to prevent any further misuse of his identity.
