Comedian Bharti Singh and husband Haarsh Limbachiyaa have landed in some legal trouble as the Narcotics Control Bureau (NCB) has filed a 200-page chargesheet against the couple in a drugs consumption case that was registered in 2020.  The chargesheet has been filed before the Esplanade Magistrate court, though the court is yet to take cognisance of it. Bharti Singh and Haarsh Limbachiyaa were arrested in connection to the drugs case in 2020 and currently the couple is out on bail.

The arrest happened in November 2020 by the NCB after ganja (cannabis) was seized from their house located in suburban Andheri. NCB officials had told at that time that 86.5 gram of cannabis was recovered from their house in a raid that was conducted as part of a probe by the NCB into alleged drug use in the entertainment industry. ANI had quoted NCB officials saying, “Both Bharti and her husband Haarsh Limbachiya accepted consumption of Ganja.”

The Magistrate Court had sent the couple into judicial custody until December 4, 2020 at the time but the couple moved a bail request stating that the drug found at their residence was only a small quantity and the case would not fetch more than a year of punishment even if found guilty after a long trial. The court then granted bail to the couple two days later on a bond of Rs 15,000 each and they were booked under sections 20(b)(ii)(A) (involves small quantity of drugs) and 8(c) (possession of drugs) and 27 (consumption of drugs) of the NDPS Act. Under the NDPS Act, up to 1 kg of Ganja is defined as a small quantity and the person possessing it is considered a consumer.

The NCB had then moved a plea before the sessions court, claiming that the bail was granted without hearing the prosecution and the agency called the magistrate’s order ‘perverse, illegal and bad in law’, which deserved to be quashed and set aside. The revision application was rejected by the special Narcotic Drugs and Psychotropic Substances (NDPS) Act court on technical grounds, after which the agency filed another application in the same issue which is yet to be heard by the Mumbai sessions court.
