The legal battle over the songs of Biwi No.1 has intensified ahead of the release of David Dhawan’s upcoming comedy Hai Jawani Toh Ishq Hona Hai. Producer Vashu Bhagnani has now moved the Bombay High Court against Tips Industries and the film’s makers, claiming they illegally used two iconic songs from the 1999 Salman Khan-starrer without securing proper rights.

Vashu Bhagnani Sues Tips, David Dhawan For Rs 400 Cr

Vashu Bhagnani’s production banner, Puja Entertainment, filed a Rs 400 crore lawsuit before the Bombay High Court on Thursday against Tips Industries Limited, Ramesh Taurani, Kumar S Taurani and filmmaker David Dhawan. The suit revolves around the use of the songs Chunnari Chunnari and Ishq Sona Hai from Biwi No.1 in Varun Dhawan’s upcoming film Hai Jawani Toh Ishq Hona Hai.

Filed through counsel V K Dubey Associates, the suit seeks urgent relief against the release, distribution, exhibition, streaming and commercial exploitation of the film and its promotional material featuring the disputed tracks.

Explaining the dispute, Bhagnani’s lawyer told ANI, “We have filed a suit with a claim of Rs. 400 crores to the Tips Music Company. The legal battle has been increasing for many days, and the rights of the musicians were not ready to be settled. Earlier, the rights of movies were based on agreements. Today, music companies buy songs from big producers or lyricists who write or create them. During that time, the agreements with Tips covered only audio rights. In 2018, Tips emailed us requesting visual rights. Vashu Bhagnani had replied to them, but their conversation did not settle.”

According to Puja Entertainment, the original agreement with Tips only covered audio rights and did not grant visual or adaptation rights for future film usage. The production house claims it later cancelled the audio rights previously assigned to Tips. The lawyer further added, “If they are the lawful owners of the music rights, they must show their documents. This is why we have filed a claim against Tips. Justice will prevail, and the truth will come out.”

The controversy escalated because Hai Jawani Toh Ishq Hona Hai not only uses the two songs but also derives its title from the Biwi No.1 track Ishq Sona Hai. Puja Entertainment has therefore demanded that the makers remove the songs from the film and promotional material. The banner has also sought a title change and warned of an additional Rs 100 crore damages claim if the demands are ignored.

Meanwhile, Tips Industries has denied the allegations. According to reports, Ramesh Taurani and his company maintain that they legally own the music and audio rights for both songs. The company issued a statement on Thursday calling the claims ‘baseless.’

The dispute comes just days before the film’s theatrical release. Directed by David Dhawan, Hai Jawani Toh Ishq Hona Hai stars Varun Dhawan, Pooja Hegde and Mrunal Thakur in lead roles. The comedy entertainer is currently scheduled to hit theatres on June 5.

On the work front, David Dhawan returns to the big screen with another commercial comedy after Coolie No. 1. Meanwhile, Varun Dhawan also has Border 2 and several upcoming projects in the pipeline, while Pooja Hegde and Mrunal Thakur continue balancing Hindi and South film projects.
