Jaya Bachchan Urges Parliament To Reconsider The Transgender Bill

Jaya Bachchan voiced her strong opposition to the Transgender Persons (Protection of Rights) Amendment Bill during a debate in the Rajya Sabha, criticising it as restrictive and misaligned with the landmark NALSA judgment. She called for better representation of the transgender community in Parliament and highlighted their cultural and mythological importance in India.

Addressing the House on Wednesday, the actor-parliamentarian emphasised the community’s significance, recalling that Lord Ram had blessed them. She stated, “This community has been immensely blessed by Ramji. He had said that on every special occasion, the presence of transgender persons would make the event auspicious.”

She further added, “In our customs, they visit homes during significant events like childbirth to offer blessings, which are considered very auspicious.”

Jaya Bachchan urged for increased political representation of transgender individuals. She said, “We need representation of this community in both Houses. Nominate at least one member. It’s essential to listen to their struggles and challenges before passing such legislation.”

What Is The Transgender Bill?

The Bill, introduced by Union Minister for Social Justice and Empowerment Virendra Kumar, has faced widespread criticism. Critics argue that it narrows the definition of transgender identity and imposes additional procedural hurdles for legal recognition. Activists and legal experts contend that the legislation departs from the Supreme Court’s NALSA verdict, which affirmed the right to self-identify gender without medical intervention.

A Supreme Court-appointed advisory committee also urged the government to withdraw the Bill, citing concerns over vague criteria and the criminalisation of transgender identities. Critics fear that mandatory medical evaluations could lead to intrusive monitoring and undermine the community’s diverse identities. The proposed amendments would replace the 2019 Act’s emphasis on self-identification with a state-controlled certification process, requiring individuals to undergo assessment by a medical board led by a chief medical officer.
